The Honourable Thomas R. Braidwood, Q.C.
ADR Chambers Inc. is an Alternative Dispute Resolution Group offering Mediation, Arbitration, Neutral Evaluation, Mini-Trial, Med-Arb, and Private Arbitration Appeals, on consent of parties, from Arbitration Awards or Trial Judgments in civil actions.
Mr. Braidwood received his Bachelor of Arts in 1953 from the University of British Columbia (UBC), and his LL.B. from UBC in 1956.
On December 6, 1990 Mr. Braidwood was appointed to the Supreme Court of British Columbia and to the Court of Appeal of British Columbia and Yukon Territories on December 19, 1996. He retired on December 29, 2006.
Mr. Braidwood was a founding partner in the law firm of Braidwood Nuttall MacKenzie, later Braidwood MacKenzie Fujisawa & Company. The new firm of MacKenzie Fujisawa was created in 1991 following Mr. Braidwood's appointment to the Bench.
Mr. Braidwood was an active participant in legal education. He was elected as a Bencher of The Law Society of British Columbia and appointed as a Life Bencher.
Mr. Braidwood is a member of other arbitral institutions and available to accept appointments from them which he will do as an exclusive member of ADR Chambers.
Mr. Braidwood was an active litigant in a wide range of areas of the law. He practised in the Supreme Court and Court of Appeal of British Columbia and the Supreme Court of Canada. A few examples of his practice involved: acting for the Federal Government in R. vs Sparrow, a leading modern native rights case; Fales vs Canada Trust, a leading case in the duties of executives; construction cases (one lasting over 121 days); criminal cases, motor vehicle accident (personal injury and insurance-related) cases; argued the London Drugs case in the Supreme Court of Canada which allowed the advertising of prescription drugs in British Columbia. He also acted for the Federal Government against The Law Society of British Columbia to allow lawyers to advertise.
As a lawyer, Mr. Braidwood acted as Counsel and as an Arbitrator. He sat as an Arbitrator on the major dispute on the cost over-run in the construction of the No. 5 paper machine at Elk Falls. He handled property evaluation matters, domestic and various other arbitrations often as chairman. He was an active litigant in estate matters as well.
While on the Court of Appeal, Mr. Braidwood wrote a dissent in the Catholic Children's Aid case, the reasons of which formed the basis for the amendment of the Law of Trusts in British Columbia.
Mr. Braidwood has recently been appointed by the Province of B.C. as the Conductive Energy Weapons Commissioner to inquire into firstly the use of CEW's in B.C. and to recommend from a policy perspective, their appropriate future use. Secondly, to inquire into and make recommendations concerning the unfortunate death that occurred at the Vancouver Airport after the use of a Taser. Mr. Briadwood has also been appointed as one of the two ethics commissioners for the 2010 Olympic Games in B.C.
While still maintaining his independent work offering opinions through his law firm, Mr. Braidwood is now pleased to offer his services as a Mediator and Arbitrator, exclusively through ADR Chambers. He is available for all forms of appointments as a neutral in Alternative Dispute Resolution and related matters.
