Harvey J. Kirsh

Harvey Kirsh is an arbitrator and mediator with ADR Chambers and is the Chair of the Construction, Engineering and Infrastructure Panel.

Harvey is a recognized authority in Canadian construction law. He arbitrates and mediates complex construction disputes and claims across the country relating to significant infrastructure, engineering, industrial, commercial and institutional projects. He has many years of experience dealing with international and domestic multi-million dollar construction claims and disputes, including claims relating to construction and design deficiencies, lien claims, claims for delay, impact and acceleration, and claims arising out of tendering/procurement disputes.

Harvey, who has been certified by the Law Society of Upper Canada as a “Specialist in Construction Law”, has acted as consultant to the Attorney-General of Ontario’s Advisory Committee on Construction Dispute Resolution Alternatives. Additionally, he is President of Canadian Construction Arbitration Services Ltd. and has been designated as a Chartered Arbitrator by the ADR Institute of Canada. He has been appointed by Infrastructure Ontario as Mediator and Adjudicator for its infrastructure projects throughout Ontario, and has also been appointed Arbitrator and Mediator with the Global Engineering and Construction Group (the only Canadian member) of “JAMS” (Judicial Arbitration and Mediation Services), the largest private provider of alternative dispute resolution services in the United States. He is also a member of the panels of arbitrators and mediators of the International Centre for Dispute Resolution (American Arbitration Association), the American Dispute Resolution Centre, and the International Arbitration Forum, and has international arbitration experience under the auspices of the International Chamber of Commerce’s Court of Arbitration.

Harvey, who was the Founding President of the Canadian College of Construction Lawyers, has authored numerous texts and more than 150 articles. He is the Founding Editor-in-Chief of the Construction Law Reports and the Founding Editor of the Construction Law Letter, and has chaired many conferences and seminars on various aspects of construction law and alternative dispute resolution. He is also an Adjunct Professor at University of Toronto’s Faculty of Law, where he teaches a course entitled “From Blueprints to Buildings: Legal Issues in the Construction Industry”.
